NOTE: For Section 246 Application filings, a Certification of compliance is required for all applications. In the certification of compliance, the applicant must declare, under the pains and penalties of perjury, that: (1) having exercised due diligence and made reasonable inquiry, the information which I have provided on this form and any attachments is true and correct to the best of my knowledge; (2) the project is in compliance with all applicable state and federal requirements and prior to construction will have received any necessary approvals for construction and operation of the project; (3) any waste generated by the construction of this project will be disposed of at a state-approved disposal facility; (4) any construction activities will follow the recommendations of the Vermont Erosion Control Handbook (available from the Agency of Natural Resources, 1-802-241-3770); and (5) I will send a copy of this complete application to all persons or entities other than State agencies listed in 30 V.S.A. § 246(c)(1) as required by the Commission’s Standards and Procedures Implementing 30 V.S.A. § 246 that were effective January 18, 2023. |
